Do Not Call Policy

As part of its routine business practice, EarthLink (and its wholly owned subsidiary PeoplePC) has in place the following polices and procedures to comply with all federal and state laws regarding making outbound calls to consumers. Any call violating these laws would be the result of error.

  1. EarthLink and its agents have established and implemented written procedures to honor consumers requests that they not be called. EarthLink and its agents use and maintain records documenting a process to prevent calls to any telephone number on its internal Do Not Call ("DNC") list, the National DNC Registry and other state lists.
  2. EarthLink and its agents access the Federal DNC Registry at least once every 31 days. EarthLink has a process for monitoring compliance with the rules and conducts periodic checks for compliance. EarthLink and its agents create lists from internal and external sources. All lists are checked against the Federal DNC List, State Lists and the internal DNC list. EarthLink and its agents download the latest list from the registry at least once every 31 days and compare it to the list to be called before calls are to be made. The internal DNC list is checked once a week. All names on any external or internal DNC list are removed from the numbers to be called. The downloaded lists are used for compliance purposes only.
  3. EarthLink and its agents have trained its personnel, and any entity assisting in its compliance, in these procedures. All persons that make calls for EarthLink and its agents are trained using the provisions of the Telemarketing Sales Rule including: The identity of the seller; Mandatory use of Caller ID; That the purpose of the call is to sell goods or services; The nature of the goods or services being offered; Time when calls can be made; Adding consumers to the internal DNC list; Acceptable and unacceptable conduct.
  4. EarthLink requires all its agents to enter into a written agreement that includes: Compliance with all laws and regulations; Maintaining a written "DNC" compliance program; Periodic tests for quality control and effectiveness; Assistance in any investigation relating to compliance with any law; Contributing to and using the EarthLink internal DNC list through specific procedures set up by EarthLink; Indemnity
  5. To be placed on the internal DNC list, call Customer Support at 888-327-8454 or mail request to EarthLink Legal Dept., DNC Request, 1375 Peachtree St., Atlanta GA 30309. You have the right to have calls stopped even if you are a customer. In some cases it may take up to 10 business days, but in no case longer than 30 days, for your telephone to be removed from other company-wide calling lists. A DNC request stays on our list for at least 5 years. If you change your telephone number or wish to add additional telephone numbers, you must provide us with the new telephone number in order for us to prevent calls to that number. If you notify us that you have received a telephone call from us after you have already requested to be placed on our DNC list, we will have a manager investigate. The manager will also personally confirm that the telephone number(s) is on the DNC list.
  6. The Federal Trade Commission offers a free service to consumers that allow them to place their residential phone number on a National DNC Registry. This service will reduce the number of telemarketing calls received. Consumers may add their residential phone number to the list either by calling 888-382-1222 or through the internet at www.donotcall.gov. It may take several weeks before you notice a reduction in calls.
  7. The methods and procedures in this DNC policy are reviewed by the DNC Compliance Monitoring and Enforcement Committee on a quarterly basis.
